Terms of Service.

The agreement that governs your use of Atlas Intensive Care's services, including in-person care, telemedicine consultations, online payments, and our website.

Welcome to Atlas Intensive Care ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our medical services, including in-person care at our Bay Area locations, telemedicine consultations, and our website at atlasintensivecare.com. By scheduling an appointment, completing a payment, or using any of our services, you agree to be bound by these Terms.

1. Services We Provide

Atlas Intensive Care offers a range of medical services including, but not limited to:

We provide all services directly. We do not subcontract medical evaluations to third parties. Specific services may evolve over time as we add capabilities or update our practice.

2. Telemedicine Services

Our telemedicine offerings include:

Synchronous visits only

All telemedicine consultations are synchronous — you and Dr. Sharma are connected live via video. Patient intake forms may be completed asynchronously through our EMR system before your visit, but the consultation itself is always live.

Time to consultation

Most appointments are scheduled within 1–2 hours to 14 days from the time of your request, depending on urgency, time of year, and the requested appointment window.

Before evaluation, we confirm your home address using a current State ID or driver's license. This verification is required by California telehealth regulations and helps ensure you are eligible to receive care under California Medical Board guidelines. Additional providers, when added in the future, will be appropriately licensed and disclosed on our website.

4. Payments & Billing

Payment processing

We use Stripe for online payment processing — including payments made through links on our website and over the phone. Stripe is a PCI-compliant third-party payment processor; we do not store full credit card information on our systems. We do not use Amazon, eBay, or other marketplace platforms.

Accepted payment methods

We accept cash, credit card, debit card, check, and most major insurance plans. For services billed to insurance, you remain responsible for any deductibles, copayments, coinsurance, or charges your plan does not cover.

Typical service fees

Cash-pay rates vary by service:

Additional services such as lab work, imaging, and vaccinations may carry separate charges. Final fees depend on the type and length of the appointment and any procedures required. We will discuss fees with you before treatment whenever possible.

Physical products

We do not sell physical products. Prescription medications are dispensed by licensed pharmacies of your choosing and are regulated by the Medical Board of California and the U.S. Drug Enforcement Administration (DEA).

5. Refund Policy

Our refund policy is designed to be fair to both patients and our practice:

Completed evaluations

Once a medical evaluation has been completed (in person or via telemedicine), the consultation fee is non-refundable. The clinical work, time, and documentation involved cannot be returned.

Partial evaluations

If a payment has been made and a partial evaluation has been conducted, you may submit a refund request within 30 days. Approved partial-evaluation refunds are issued at 15% of the fees paid, excluding payment processing charges, credited back to the original payment method.

Unscheduled or unexecuted evaluations

If a payment has been made but no evaluation occurs within 30 days, you may request a refund of 50% of the fees paid, excluding payment processing charges, credited back to the original payment method.

How to request a refund

Submit refund requests in writing to [email protected] with your name, date of service, and reason for the request. We aim to process eligible refunds within 10 business days of approval.

6. Prescriptions & Pharmacy

When prescriptions are appropriate at the conclusion of an evaluation, we use the integrated SureScripts e-prescribing platform to send prescriptions electronically to your pharmacy of choice. For controlled substances, we use Electronic Prescribing of Controlled Substances (EPCS) in compliance with DEA requirements.

We have no partnerships with any pharmacy. You are free to choose any licensed pharmacy based on location, price, or convenience. We do not receive any compensation, referral fees, or other consideration from pharmacies for sending prescriptions to them.

The decision to prescribe any medication is made solely by the treating physician based on clinical appropriateness. We reserve the right to decline to prescribe any medication when we determine it is not in the patient's best interest.

7. Privacy & HIPAA Compliance

Atlas Intensive Care is fully HIPAA compliant. We protect your health information in accordance with the Health Insurance Portability and Accountability Act (HIPAA) and California medical privacy laws.

We use a HIPAA-compliant telemedicine platform for all video consultations. Our electronic medical record system, payment processor (Stripe), e-prescribing system (SureScripts), and any other vendors who handle protected health information are bound by Business Associate Agreements as required by federal law.

Detailed electronic records also serve as documentation in the event of a payment dispute, supporting both fraud prevention and patient privacy. For full details on how we use and disclose your health information, please refer to our Notice of Privacy Practices, available upon request.

By using our telemedicine services, you provide informed consent to receive medical care via telehealth. We obtain and document verbal or written consent before each telemedicine visit, in accordance with the California Medical Board Telehealth Guidelines.

9. Fraud Prevention & Disputes

We monitor for fraudulent activity through Stripe's built-in fraud detection tools and our own intake verification processes. To minimize disputes, we collect appropriate identifying information at the time of booking and payment.

In the event of a payment dispute, our HIPAA-compliant electronic records serve as documentation of services rendered. We strive to resolve all disputes promptly and in good faith. Our chargeback and dispute rates have historically been minimal, and we work continuously to maintain that record.

10. Medical Emergencies

Atlas Intensive Care does not provide emergency services. If you are experiencing a medical emergency — including but not limited to chest pain, severe difficulty breathing, signs of stroke, severe bleeding, suicidal thoughts, or any life-threatening condition — call 911 immediately or go to your nearest emergency room.

Our telemedicine and outpatient services are not appropriate substitutes for emergency care. Do not use our services to address acute, life-threatening situations.

11. Limitations of Liability

To the maximum extent permitted by law, Atlas Intensive Care, its physicians, staff, and affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, except where such limitation is prohibited by California or federal law.

Nothing in these Terms limits our liability for medical malpractice, gross negligence, or willful misconduct, nor does it limit any rights you may have under applicable patient protection laws.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practice, applicable law, or operational practices. When we make material changes, we will update the "Last Updated" date at the top of this page and, when appropriate, provide additional notice through our website or in your patient communications.

Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

Articles, guides, and other health information published on this website (including our Health Library) are provided for general educational purposes only. They reflect general standards of care at the time of writing and are not medical advice, do not create a physician–patient relationship, and are not a substitute for an individual consultation with a qualified clinician who knows your history.
